James Cohen features in EPrivateClient

James Cohen, Partner and Head of Private Client, was featured in EPrivateClient sharing his insights on the expectation that the United Arab Emirates (UAE) will ease expat tax rules.

James commented on the importance of the area an individual relocates to when it comes to overall tax and residency position, stating “many jurisdictions apply stricter day-count tests or ‘centre of vital interest’ analyses, meaning the new country may assert tax residency even if UAE status is technically retained. This can create dual residency conflicts, particularly if the destination country has higher tax exposure or more aggressive enforcement.”

James added that access to double-tax treaties, and the application of tie-breaker rules, will “heavily influence” the outcome, stating “the legal risk often shifts from the UAE’s flexibility to the rigidity of the jurisdiction the individual moves to.”
